North Carolina General Statute95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a)job site- employees were using a 5/8" wire rope on a hydraulic winch hoist to disassemble a large Giant Seattle Wheel ( ferris wheel). The wire rope was attached to a thimble and hook and held in place with an aluminum swage fitting. The swage fitting failed allowing the sweeps of the Wheel to swing. The sweeps struck a walk board which was near the axle of the Wheel causing an employee to fall from walk board to the pavement 44 feet below and also struck a man basket on the equipment throwing the employee from the man basket to the pavement approximately 28 feet below on or about 5/16/11. Abatement Note: Among other methods, one feasible abatement method to correct this hazard is to consult the manufacturer of the wire rope cable system and use standard load charts to determine safe working limits of all components in the system. Components can be selected to insure that the safe working load is not exceeded.
