Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck and crushed by heavy equipment after being thrown from the equipment: a.) for the operators of a John Deere 544H front-end loader, as noted on or about 03/21/2011. The seatbelt for the front-end loader had been secured under the seat prohibiting its use by the operators. On or about 03/18/2011, about one-half mile east of 1762 S. Lake Reedy Blvd in Frostproof (FL), an operator was ejected from the front-end loader after a pallet-fork attachment came off and was run over during its transit to a grove. After being ejected to the front and side of the loader, the operator was run over and sustained fatal injuries. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure all operators follow the manufacturer's instructions requiring the use of the seat belt during its operation. Additionally, an inspection checklist could be used, and enforced, to ensure operators verify the seatbelt's ability to be used.
