Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential struck-by and/or caught in-between hazards: (a) At the Fullerton Farmers Elevator where, on or about 03/02/11, an employee was caught between the couplers on two railcars while railcars were being loaded with corn and moved, and the employee had not been provided with a means of communication to alert him to railcar movement. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide communication equipment to all employees engaged in the movement of railcars.
