Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: West nursery road; on or about April 17, 2011, employee groups engaged in the pulling of customer plant orders used farm tractor pulled trailers to transit the nursery and move the plants from the growing grounds to the loading docks; excessive speed of tractors going down hill resulted in the loss of tractor control. This exposed employees to the hazard of being struck by a tractor and/or its attending trailer(s); this includes over turning tractors. A fatal accident occurred when a tractor operator lost control of a tractor and was ejected; the tractor subsequently overturned striking the operator. Employees riding on the trailers received abrasions, with one receiving severe finger lacerations. Among other methods, one feasible and acceptable abatement method to correct this hazard is to assure that all tractor operators are trained on their responsibilities to safely operate tractors and that management rigidly enforces safe speed control.
