Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: The employer violated this standard on or about April 14, 2011 when the United States Postal Service did not ensure that employees walking mail delivery routes were not exposed to the recognized hazards of being struck by trains. A feasible and acceptable method of abatement to correct this hazard is to develop work rules and provide training regarding railroad crossings following the Uniform Vehicle Code, UVC 11-513(b) Pedestrians near At-Grade Railroad Crossings: Bridge and railroad signals. The UVC is referenced in the Manual on Uniform Traffic Control Devices (MUTCD) and is model set of motor vehicle codes and traffic laws for use throughout the United States. MUTCD is adopted in 23 CFR, Part 655.603.
