Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about September 15, 2010 an employee was operating a Bobcat S150 skid steer loader without being familiar with and without inspecting the base to determine if it was strong enough for the load applied, thereby exposing the operator, the employee guiding the loader and the loader to a potential fall hazard in excess of 12' and a crushing hazard when the floor failed. Among other methods one feasible and acceptable method to correct this hazard would be to: - Read and follow the Bobcat Operation and Maintenance Manual which requires that the operator must know any prohibited uses or work areas, such as excessive slopes. - Read and follow the Association of Equipment Manufacturers Safety Manual for skid steer loaders which requires an inspection of the surfaces over which the loader will travel for holes, drop-offs, obstacles, rough spots, hidden obstacles, weak spots on floors, oil spills, wet spots,slippery surfaces, soft soil, deep mud or standing water or for anything that may cause loss of control or roll over.
