Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation from rotating/moving blades: a) Storage Room Area - Provision was not made to prevent the vertical metal cutting band saw, from automatically restarting upon restoration of power after a power source failure. b) Tool Room Area - Provision was not made to prevent the vertical metal cutting band saw, from automatically restarting upon restoration of power after a power source failure. Among others methods, one feasible and acceptable means of abatement in an event of interruption in the electrical supply to the saw would be to provide an electrical device that is designed to prevent the saw from restarting automatically when power is restored, such as a magnetic restart or similar device as prescribed by the American National Standard Institute for Metal Sawing Machines, ANSI B11.10-2003, Section 6.11. No abatement certification or documentation is required for this item.
