Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: At this location, on or about July 01, 2010 employees involved in a watermelon harvesting operation were not prohibited from riding on the produce trailer, loaded with watermelons, from the fields to the paved FM road at the farm entrance. The produce trailer was not equipped with passenger seating. Employees sat on the watermelons or stood on the trailer hitch, the tongue of the trailer, or wherever space was available. Employees riding on top of the harvested watermelons and/or standing on the trailer were exposed to falling and struck-by hazards: Among other methods of abatement, one feasible and acceptable means of abatement would be to provide employee transport to and from the fields in a vehicle equipped with approved passenger seating and instruct employees not to ride on trailers or wagons loaded with harvested crops or empty.
