Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck or burned by exploding pyrotechnics: a)On or about 11/20/10, At the Display Site: Employees were exposed to the hazard of explosion and fire, due to the continued lighting of the pyrotechnic display after a serious accident had occurred. Among other methods, feasible and acceptable abatement methods to correct these hazards are to: 1) Follow the requirements of NFPA 1123, Code for Fireworks Display, 2010 edition. Including, but not limited to: Ensuring that in the event of a condition arising that requires the entry of fire protection or other emergency response personnel into the security perimeter, the display shall be halted (8.1.4.4). Abatement certification must be submitted for this item.
