Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5a.0001 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a vehicle: a) On or about 09/25/10 and at times prior there to employee(s) are exposed to being struck by two semi trailers while unloading a mud tank. AMONG OTHER METHODS, TO CORRECT THIS HAZARD IS TO COMPLY WITH AMERICAN PETROLEUM INSTITUTE (API), API RECOMMENDED PRACTICE 54 THIRD EDITION, AUGUST 1999 SPECIAL SERVICES SECTION SUB-SECTION COMMUNICATIONS 12.3.1 & 12.3.2. ANOTHER METHOD, FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ESTABLISH A SYSTEM TO INCLUDE PROCEDURES FOR BACKING UP SEMI TO LOAD AND UNLOAD FREIGHT. SUCH A PROGRAM MAY INCLUDE BUT IS NOT LIMITED TO: 1. A DRIVER BACKS UP ONLY WHILE THE DRIVER MAINTAINS EYE CONTACT WITH THE EMPLOYEE BACKING UP THE SEMI AND THAT EMPLOYEE SIGNALS THAT IT IS SAFE TO DO SO. 2. ESTABLISH SYSTEM THAT INCORPORATES CLEAR SIGNALS TO LET DRIVERS KNOW WHEN A FLAGGER IS IN CONTROL OF BACKING UP A VEHICLE OR AN EMPLOYEE IS TO BE WORKING BEHIND THE VEHICLE. 3. ENSURE THAT A DRIVER HONKS THEIR HORN WHEN EVER THEY ARE BACKING UP.
