Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to hazard of chemical asphyxiation from carbon monoxide inhalation: The employer does not prohibit the use of a gasoline-powered pressure washer indoors for cleaning purposes. This condition last occurred on or about March 3, 2010, at the Church's Chicken, located in Kenedy, TX, where an employee assigned to clean the floor and walls of a walk-in cooler used a Husky gasoline- powered pressure washer. The employee suffered exposure to a potential Immediately Dangerous to Life or Health (IDLH) atmosphere of carbon monoxide. Among other methods, one feasible means of abatement, is to relocate the power washer outdoors. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including an explanation of how these steps protect employees from asphyxiation from carbon monoxide.
