Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling structural steel members: a)290 Hayward St., Brooklyn NY: Structural steel members that were being delivered to a construction site on the bed of a Kenworth model P800 24 foot flatbed truck that was provided with a Fassi model 390 crane, were not stacked, blocked, or otherwise secured so that they will not be displaced when the tie down straps are loosened or removed. On or about 11/20/09. Abatement Note One feasible and acceptable method, among others, to eliminate, or to materially reduce this hazard is to block, or otherwise secure loads so that they will not become displaced and fall when the tie down straps are loosened and/or removed. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
