North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)at the stainless steel production area, on or about October 29, 2009, employee was not adequately protected from struck-by injuries during the pressurized leak testing of thirty pound fire extinguisher bodies in the event that a fire extinguisher body explosively failed. Among other methods, two applicable and feasible methods of abatement is to test the thirty pound fire extinguisher bodies hydrostatically or pressure leak test thirty pound fire extinguisher bodies in an vault or room designed to contain the potential energy of an explosive failure and view the test remotely by camera if necessary.
