Text For Citation: 01 Item/Group: 001 Hazard: CUTS
Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure Bakery Associates adhered to safety requirements contained in the Thermoglaze operator's manual, as follows: a.At the Wal-Mart Supercenter Store #5070, donut thermoglaze cleaning activities, Bakery Associates were exposed to finger amputations while cleaning the glaze- carrying parts of the donut Thermoglaze including hoses, impellers, couplers and. The employees were operating and cleaning the machine without reading the manufacturer's operator's manual prior to performing such activities as was required by the manufacturer's specific instructions and warnings. Employee #1 suffered a partial amputation down to the most distal joint of her middle finger on her right hand while cleaning the machine when the power was on. Bakery Associates' cleaning activities did not include: -Disconnecting the Thermoglaze from power; -Disassembling all glaze-moving parts and hand washing them with warm soapy water (Bakery Associates were either wiping down parts with a paper towel or running soapy water through the machine while it was energized). Other activities identified as evidence Bakery Associates had not read the operator's manual include: -Forcing donut racks through the conveyer assembly rather than allowing the Thermoglaze to engage movement automatically once the oven reached required temperatures. Study the instructions and warnings in this manual carefully before operating the equipment. A thorough understanding of how to install, maintain, and safely operate the Thermoglaze will prevent production delays and injuries. To use the Thermoglaze safely, heed the following warnings and all other warnings that appear in this manual: *To avoid damaging the Thermoglaze, never use force to assemble, disassemble, operate, clean, or maintain it.One form of abatement would be to require all Bakery Associates and Managers that supervise them to read the operator's manual and enforce all safety requirements contained therein.
