Section 5(a)(1) of the Occupational safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed and/or caught between the skid steer loader and its parts while in operation: On or about November 30, 2009, at a jobsite located at 400 East 130th Street, Chicago, Illinois - a) an employee was operating a New Holland LS180 Skid Steer with inoperable safety devices. Among other methods, one feasible and acceptable means of abatement to correct the hazard would be follow the manufactures recommendations and perform daily inspections of the seat belt and other safety devices on the equipment stated in the New Holland LS180 Skid Steer Operator's Manual, and/or The Equipment Manufacturers Institute (EMI) Skid Steer Loader Safety Manual which states "Caution" Inspect the seat belt regularly to be sure it is not damaged in the buckle," "Check the seat belt/seat switch(es) for damage and proper operation;" and, "Observe gauges, instruments and warning lights to assure that they are functioning and their readings are within the operating range." b) an employee operating a New Holland LS180 Skid Steer was wearing loose clothing which could get caught on operating gears and cause the vehicle to be put in motion upon the employee entering or exiting the vehicle during routine operations. Among other methods, one feasible and acceptable means of abatement to correct the hazard would be follow New Holland LS180 Skid Steer Operator's Manual, and/or The Equipment Manufacturers Institute (EMI) Skid Steer Loader Safety Manual which states "Warning" DO NOT wear loose clothing or any accessory that can catch in moving parts or controls."
