Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that employees were exposed to falling loads due to an inoperable safety latch. a) On or about May 26, 2010, the employer failed to ensure the hook for the line three ARO hoist (Model 7756E, Serial # C9215944) had an operable safety latch. Employees hoist small engines and riding lawn mower frames for assembly purposes. The load became dislodged from the hook and struck an employees hand. Among other methods, a feasible abatement method to correct this hazard is to comply with the requirements of ASME B30.10-2005 "Hooks", Section 10-1.2.3 Maintenance. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
