Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: On or about January 6, 2010 at the worksite, Tiger Trucking, Inc did not insure ignition sources were not present when employees attempted to thaw butterfly valves on a vacuum truck, exposing employees to a fire and explosion hazard. A feasible means of abatement is to develop and train employees in a safe procedure to thaw butterfly valves without any possible ignition sources in the vicinity following the API Recommended Practice 2219-2005 Safe Operation of Vacuum Trucks in Petroleum Service.
