Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On or about August 17, 2009, employees were placing fabric over freshly poured concrete on the overpass at the Medina, North Dakota, exit on Interstate 94 when wind gusts of approximately 40 mph caused the fabric to fly into the employees forcing one employee through the existing guardrail system and falling to the highway below. Among other methods, feasible and acceptable methods to correct this hazard would be to not place fabric until the wind decreased or use additional measures to prevent the fabric from being caught by the wind.
