Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of: On or about September 25, and at times prior thereto, at the facility located at 7755 North Highway 393, Scranton, Arkansas, the employer did not ensure that each employee working in the Dump Room Area, in proximity to an offal bin, was trained as necessary by a qualified competent person, exposing the employees to the hazards of drowning and/or asphyxiation. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that each employee is effectively trained by a competent person, provided supervision by a competent person for the period the employee is considered
