Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck when not wearing a seat belt. (a) Warehouse Dock #1; on or about April 11, 2010 and at times prior thereto, Hyster #14, Model# ZLH40XMS, Serial # E001H03137B; propane powered forklift, was used to load Compton truck #71, a 24 foot International Box van, with a pallet of communication equipment. Seat belts were not used by the operator, nor were they required to be used. (b) Warehouse, on or about April 11, 2010 and at times prior thereto, #02 -Nissan model KPH01A IBPV, Serial # KPH01P900809; propane powered forklift, was used for handling and storage of equipment and supplies, was operated by employees without the protection of a seat belt installed in the vehicle. The fork lift was originally provided with a seat belt, but it had been removed. (c) Covered Storage Yard next to Warehouse, on or about April 22, 2010 and at times prior thereto, #21-Mitsubishi model FG-40, Serial # AF29-50250; propane powered forklift, was used for handling and storage of wood fencing in the outside yard, was operated by employees without the protection of a seat belt installed in the vehicle. The fork lift was originally provided with a seat belt, but it had been removed. Note 1: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all forklift operators wear seat belts during operation of the vehicle is equipped with the appropriate restraint device, system, or enclosure as required by section 7.41 of ANSI/ITSDF B56.1-2005. Note 2: Abatement certification and documentation IS required for this item.
