Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck- by. (a)At the delivery site, where an employee was assisting a forklift operator in removing a 700 pound tank assembly from a flatbed truck on March 2, 2010. The employee was standing adjacent to the tank assembly, exposing him to falling objects while the truck was being off loaded. A feasible abatement method, among others would be: require employees to vacate the unloading area once the employee has unsecured the cargo from his/her truck and require employees not to enter the loading/unloading area until all items have been loaded/unloaded to/from the transport truck.
