Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from the top of tanker trailers: (a)On or about 09/26/2008 - Located at the Warrior Asphalt Refining Corporation - Tuscaloosa, Alabama - Polymer Loading Rack - Drivers that accessed the top of tank trailers to open the dome lids for the receipt of asphalt were exposed to falls of approximately 10 feet to the ground. Among other methods, one feasible and acceptable method to correct this hazard is: In the event that railings are not provided at loading racks to prevent falls when accessing the dome lids then personal fall restraint systems, such as a positioning device that would restrain the employee from falling and allow the use of both hands while opening the dome lid from the ladder would be a feasible and useful method to correct the hazard. Or in the alternative: 29 CFR 1910.132(a) Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition whenever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: (a)On or about 09/26/2008 - Located at the Warrior Asphalt Refining Corporation - Tuscaloosa, Alabama - Polymer Loading Rack - Drivers that accessed the top of tank trailers to open the dome lids for the receipt of asphalt were exposed to falls of approximately 10 feet to the ground.mately
