Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and falling hazards: a)Freight elevator operators control handle at 29 West 36th Street: Handle of lever-type operating device of freight elevators did not return to the stop position and latch there automatically when the hand of the operator was removed. On or about 9/12/08. b)Freight elevator car gate at 29 West 36th Street: Freight elevator car gate electro-mechanical interlock was bypassed with tape so that the elevator could run with the gate open. On or about 9/12/08. c)Freight elevator north shaft door on the 5th floor at 29 West 36th Street: The freight elevator shaft door electro-mechanical interlock was bypassed internally with a jumper wire. On or about 9/12/08. Among other methods, one feasible and acceptable method to correct this hazard is: 1)Comply with American Society of Mechanical Engineers A17.3-2002, 3.10.2 by repairing and maintaining lever-type operating devices of freight elevators so that they return to the stop position and latch there when the hand of the operator is removed. 2)Comply with American Society of Mechanical Engineers A17.3-2002, 3.10.7 and remove devices which render hoistway door interlocks or car door or gate electric contacts inoperative. 3)Instruct employees on the danger of bypassing the elevator locks, interlocks, and / or switches. 4)Inspect all elevator locks, interlocks, and / or switches for objects used to bypass them. Remove objects found and do not allow use/operation of the elevators doors / cars until the objects are removed. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
