North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards when a catwalk was corroded and/or rusted: a)establishment, block incline conveyor - where employees walked and worked on a catwalk that was corroded (rusted) and defective. The employer did not maintain/repair the catwalk along the inclined conveyor to maintain its structural integrity and to prevent deterioration from rust and corrosion. On or about November 17, 2008, an employee was fatally injured when the 15th section plank support bracket that was corroded broke at the weld joints causing an employee to fall approximately 38' to the ground below. Abatement note: One feasible and acceptable abatement method is to develop a maintenance program to ensure safe facility operations and conditions of the conveyor, structure and catwalk components.
