Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from caught in between or struck-by: At the worksite: On or about June 25, 2009, and at times prior thereto, the employer required an employee to operate a powered industrial truck with a lifting device attachment without all personnel clear of the area per the manufacturer's instructions. Employees were exposed to the hazards associated with struck-by and caught in between. Among others, one feasible and acceptable method of abatement would be to comply with manufacturer's operation instructions per the owner's manual for the lifting device attachment.
