Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:06/09/08 Location:Pennington Avenue Bridge, "Basement" Level Condition:Employees were exposed to adverse health effects from exposure to carbon monoxide while working in an unventilated area where a gasoline-powered pump was previously operated for 2 days without the addition of mechanical ventilation and without performing any atmospheric testing prior to entering the space and beginning the work. Among other methods, feasible and acceptable abatement methods to correct this hazard include: ensure that gasoline-powered equipment is not used in enclosed areas without proper ventilation; educate employees on the potential sources and hazards of carbon monoxide, and how to recognize symptoms of carbon monoxide exposure; adhere to manufacturer warnings regarding the use of gasoline powered equipment; use direct reading instruments to monitor carbon monoxide levels in work areas where gasoline powered equipment is operated. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
