Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Production Area- Dry Side: A fiberglass ladder was modified from the original manufacturer's specifications and used as a fixed ladder as part of a platform. One feasible and acceptable means of abatement is to install a metal industrial ladder manufactured for the purpose. Observed on or about 11/5/08 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
