Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
NCGS 95-129(1) section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by vehicular traffic: a)construction demolition landfill - for the employee(s) performing waste stream analyses at the working face of the landfill while trucks were dumping waste, on 4/23/08 an employee conducting waste stream analyses was struck and dragged nine feet by the tailgate door of a truck dumping construction waste. Among other methods, one feasible and acceptable abatement method to correct the hazard and to prevent the recurrence of such hazards, is to remove the spotter from the moving truck hazard. This could be accomplished by requiring that the spotter do waste stream analysis from a truck or bulldozer cab.dozer
