Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to injuries from an explosion and fire hazards: a) On or about November 24, 2008, the employer as the creating/exposing contractor did not protect employees/workers from explosion and fire hazards in that; 1) The piping outlets to the first floor fire places were not capped or plugged until connected to the appliances. 2) The L.P. piping system was not inspected and tested prior to pressuring the system. 3) Ignition sources were not controlled during the pressurizing of the L.P. system. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to inspect all gas piping and appliances in accordance with NFPA section 54, and the International Fuel Gas Code.
