Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an inadequate use of seatbelts while operating fork trucks A)Max General Distribution, pallet area - On or about 5/27/09, employees were not wearing the seatbelts provided on the Hyster fork trucks when they were operating the forklifts. The condition potentially exposed employees to caught-between/crushing hazards. B)Max General Distribution, warehouse area - On or about 5/27/09, employees were not wearing the seatbelts provided on the Toyota fork trucks when they were operating the forklifts. The condition potentially exposed employees to caught-between/crushing hazards. ABATEMENT NOTE: Among other methods, feasible and acceptable methods to correct the conditions would be to enforce seatbelt use on forklift trucks as required in ANSI B56.1
