Text For Citation: 01 Item/Group: 005 Hazard: GUARDING
Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer did not ensure that a hot work inspection was preformed, as follows: a.Located at the Monte Carlo Resort and Casino, a team of sub-contractor employees were performing hot work operations on an upper platform of the roof. The employees were installing a platform davit system (catwalk) that would encompass the entire interior wall. While installing the catwalk, the employees were using a saws-all, an angle grinder and an oxygen-acetylene torch to reach and remove welds that had been left there from the previous installation. A fire started when sparks from the hot work operations landed on the lower section of an adjacent wall igniting a blaze. The fire continued to travel to the exterior facade and to several upper floors of the resort and casino. An inspection of the hot work area was not preformed to identify combustible materials in the area and to guard openings in the adjacent parapet wall. Employees were exposed to serious injuries from the fire. Reference: 2000 Uniform Fire Code, Article 49 - Hot Work, Section 4901 - General, 4901.6.3 Hot-Work site Inspection. The hot-work site shall be inspected by the individual responsible for the hot work for compliance with Section 4901.5. The inspection of the hot-work site shall ensure that: 1.The hot-work site is clear of combustibles or that combustibles are protected; 2.Exposed construction is of noncombustible materials or that combustible materials are protected; 3.Openings are protected; 4.Floors are kept clean; 5.There are not exposed combustibles on the opposite side of partitions, walls, ceilings and floors; 6.Fire watches are assigned, equipped and trained; and 7.Fire extinguisher shall be verified as operable and a available. One feasible means of abatement is to follow the hot work requirements set forth in the 2000 addition of the Uniform Fire Code.
