Text For Citation: 01 Item/Group: 003B Hazard: GUARDING
Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: In the alternative, the employer did not ensure that openings were guarded, as followed: a.Located at the Monte Carlo Resort and Casino, a team of sub-contractor employees were performing hot work operations on an upper platform of the roof. The employees were installing a platform davit system (catwalk) that would encompass the entire interior wall. While installing the catwalk, the employees were using a saws-all, an angle grinder and an oxygen-acetylene torch to reach and remove welds that had been left there from the previous installation. A fire started when sparks from the hot work operations landed on the lower section of an adjacent wall igniting a blaze. The fire continued to travel to the exterior facade and to several upper floors of the resort and casino. Openings or cracks in the wall were not tightly covered to prevent the passage of sparks to the adjacent parapet wall. Reference: 2000 Uniform Fire Code, Article 49-Hot Work, Section 4901 - General, 4901.5.4 Openings; Openings or cracks in walls, floors, ducts or shafts within the hot-work area shall be tightly covered to prevent the passage of sparks to adjacent combustible areas, or shielding by metal or fire-resistant guards or curtains shall be provided to prevent passage of sparks or slag. One feasible means of abatement is to follow the hot work requirements set forth in the 2000 addition of the Uniform Fire Code.
