Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rollover and/or struck by hazard(s) while operating ATVs. a)Establishment: On November 13, 2007, and at times prior thereto, the employer did not ensure employees had been trained, were qualified, and safely operated All-Terrain Vehicles (ATVs) including, but not limited to, appropriate speeds, operating surfaces, emergency braking and maneuvers, tire pressures, and driving behavior. Note: Abatement certification and documentation IS required for this item. Feasible and acceptable abatement methods to correct this hazard include: 1) Obtaining the operator''s manuals for the model of ATV used and ensuring employees are familiar with the manufacturer''s safe operating instructions; and 2) Implementing an ATV safety training program such as the ATV Safety Institute''s ""Rider Course"" to provide hands-on training and knowledge of proper ATV operation.
