Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards while being lifted up approximately thirty feet in a wooden box putting furniture through a window that was secured to the mask of a forklift by using a synthetic web tie down. (a)HNF Installation- On or about November 7, 2007 the employer used a JLG forklift to elevate two employees approximately thirty (30) feet and the employer used a damaged synthetic web tie down that should have been removed from service due to holes, tears, cuts, broken and/or worm stitching and a knot tied in the web tie down in an ineffective attempt to secure the platform to the JLG forklift. Among other methods, one feasible and acceptable method to correct the hazards includes but not limited to : Comply with the Web Sling & Tie Down Association, Section 4.7, Removal from Service. This section states that a synthetic web tie down shall be removed from service if any of the following are visible: a. Holes, tears, cuts, snags or embedded particles which cause doubt as to the strength of the tie down b. Broken or worn stitching in load bearing stitch patterns c. Excessive abrasive wear d. Knots in any part of the webbing
