Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:08/29/07 Location:Throughout the Mill Condition:A system for the production of granulated cork and collection of cork dust, an explosive dust, was not maintained, nor was it designed and installed under the supervision of a qualified engineer knowledgeable of these systems and their associated hazards, to prevent fire or explosion from occurring. Among other methods, one feasible and acceptable abatement method to correct this hazard is to have a qualified engineer inspect the system to ensure it is designed, installed, and maintained in accordance with National Fire Protection Association (NFPA) 654, Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing and Handling of Combustible Particulate Solids. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
