Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with collapses of precast masonry walls: On 1 August 2007, and at other times prior thereto, pipe bracing used to support tilt-up walls were installed with the following hazardous conditions: a.The pipe brace foot plates did not bear completely on the concrete floor at various points of attachment to the slab foundation or dead-man footing. b.Attachment bolts did not bear fully on the pipe brace foot plates. c.The attachment bolts and nuts were not tightened at all of the brace foot plates to prevent slippage. Among other methods of abatement, one feasible method of abatement would be to comply with the general information and instructions for use of Dayton Superior Tilt-Up Products provided by Dayton Superior in the installation of brace anchors.
