Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being crushed while moving a railcar: 1. The employer did not ensure that employees required to unhook a chain from a moving railcar perform the task safely by establishing and implementing a safe operating procedure, visual observation, direct instructions, and training. a) Plant yard - On or about November 24, 2009, an employee was exposed to a hazard of being crushed between the railcar and the tractor rear wheel. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. Utilized a toolbar system that would have stopped the railcar when the tractor stopped. 2. Utilized equipment designed to safely pull railcars. 3. Conducted a hazard assessment of the work process. 4. Established and implemented safe procedures for the movement and placement of the rail cars. 5. Trained employees in the safe procedures. 6. Utilized other engineering technology.
