Section 27-a(3)(a)(1): The employer did not furnish to each of its employees, employment, and a place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety, or health of its employees: DESCRIPTION OF HAZARD: a) NYCTA 59th Street Train Station, 59th Street and 8th Avenue New York City During the performance of their assigned duties including placing warning flags on the tracks, trackworkers are exposed to the safety hazard of impact with moving trains. Employee exposure to this hazard may result in skeletal injuries, crushing, amputation and death. Reasonable and adequate methods to abate this hazard may include but is not limited to: 1. Compliance with American Public Transportation Association Volume 4 Standard for Work Zone Safety which state "before entering the track area wayside workers shall notify the control center and/or yardmaster and receive authorization. 2. Training: Ensure that all affected employees participate in the Division of Track, Maintenance of Way, Annual Safety Stand Down Training Course. The training shall include, but is not limited to, instruction on how to work safety within the train "Right of Way" and how to work in areas adjacent to train tracks and the proper implementation of safe workzones on the tracks.
