Text For Citation: 01 Item/Group: 001A Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: a) On or about 3/28/2008, at 800 Penn Grove Road, Landenberg, PA. the employer did not furnish a place of employment which was free from recognized hazards in that an employee was fatally wounded when he was struck and run over twice by a Caterpillar 908 Compact Wheel Loader, with pallet forks attachments used to carry bales of hay. The loader was traveling forward with an obstructed view, and in close proximity of other employees who were cutting hay strings. At the time of the accident the horn of the vehicle was not in good operating condition. The employer failed to instruct the operator in the operation of this vehicle and failed to follow the manufacturer's instruction on how to operate this equipment when the forward visibility is impaired by the load. Reasonable and feasible methods of abating this hazard would include but not be limited to: 1. Establish separate work zones for machinery and employees. In this manner reducing interaction between the employees cutting the bale's strings and machinery delivering and pushing hay. 2. Training. Ensure personnel operating the wheel loader are properly trained. 3. Follow the wheel loader manufacturer's instructions and recommendations of driving backwards when the material carrying impairs the visibility. NOTE: ABATEMENT DOCUMENTATION REQUIRED.TION
