Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards of over 11 feet when performing work tasks which include but are not necessarily limited to confined space entry activities on top of vacuum trucks: Among other methods, one feasible and acceptable means to correct this hazard would be to provide a safe means to access the top of the truck and providing an acceptable means of fall protection to those employees working on top of the truck.
