Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard and to the hazard of being caught / struck by a moving elevator: Location: 1359 Broadway, New York, N.Y. On or about 10/18/06. a)The elevator gate interlock on Freight Car #3 was jammed with a piece of cardboard causing it to be inoperable. The car was being run with the gate open, exposing employees to the hazard of being caught between the moving elevator and the hoistway walls. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: a)(Jammed Interlocks) Maintain the elevators to ensure gates, doors, and interlock switches work correctly, to comply with ANSI A17.3 paragraph 3.4.2 which requires operable elevator gates and interlocks. Monitor and inspect the elevators to ensure interlocks are not tampered with. Provide re-training to employees to familiarize them with this hazard so they can report this condition when it is observed. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
