Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Ellwood Engineered Castings Company worksite, Hubbard, Ohio: During hot metal pouring and related activities in the casting department, employees were exposed to the hazard of having molten iron splash out over the top of the ladle and down onto them due to the lack of a limit being set as to how full ladles were permitted to be filled. Among other feasible means of abatement, one way to protect workers would be to follow the precepts of section 9.9.1 of the American Society of Testing Materials E 2349-05 (Safety Requirements in Metal Casting Operations: Sand Preparation, Molding and Core Making; Melting and Pouring; and Cleaning and Finishing), which states that ladles will not be filled above a level where the potential exists for spillage to occur during normal transportation.
