North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by/crushed by the load of an inclined vehicle that was only secured by the winch cable: a)accident site - where the employer did not establish and implement safe operating procedures for towing vehicles. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the procedures outlined in the operator's manual.
