Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall from an inadequate protected open-sided floor: a) In the separator building at the site, on January 10, 2007, and at times prior thereto, employees were exposed to multiple injuries and/or death created by the lack of a midrail and a top rail that was not fastened in place and easily displaced at the wall opening approximately 15 feet above the lower level. The employer did not install railings that comply with the provisions required by The American National Standards Institute (ANSI) A12.1,1973: Safety Requirement for Floor and Wall Openings, Railings and Toeboards. Among other feasible and acceptable abatement methods to correct this hazard is to install a midrail and secure the top railing to prevent inadvertent movement according to the provisions required by The American National Standards Institute (ANSI) A12.1,1973; section 4.1, Every wall opening from which there is a drop of more than 4 feet shall be guarded. Section 7.9, Wall opening barriers shall be of such construction and mounting that, when in place at the opening, the barrier is capable of withstanding a load as specified in section 7.3, Minimum requirements for guard railings. Also, installing guardrails to conform to the General Industry Standards 29 CFR 1910.23; Guarding Floor and Wall Openings and Holes, would be acceptable. No Abatement Certification or Abatement Documentation required.
