Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: On or about February 28, 2006, and other times prior thereto, at this location, employees pumped lube oil into an open hatch on top of tanker trucks approximately 10 feet from the ground, without an adequate fall protection system. Among other methods, recognized and feasible abatement to prevent exposure to this hazard, includes, but not limited to, the use of guardrail systems or personal fall arrest systems.
