Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion: On or about February 28, 2006, and at other times prior thereto, at this location, employees were pumping lube oil into the upper dome of a tanker truck that previously contained a Class I liquid. Proper precautions to prevent hazards due to a change in the flash point were not taken, so as referenced by NFPA 30-2003 - Chapter 7. Among other methods, recognized and feasible abatement to prevent exposure to these hazards, includes, but is not limited to, the use of a Lower Explosive Limit (LEL) meter anytime a tanker is opened to measure the LEL of the atmosphere inside the tanker to ensure that a flammable atmosphere does not exist before continuing operations.
