Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of electrical shock, falls, being struck by limbs and other hazards associated with arboricultural operations: a) On or about June, 01, 2007, the employer did not establish methods and procedures to control and eliminate such hazards as, but not limited to electrical shock, falls, delayed medical treatment and the like. Among other abatement methods, feasible and useful to abate these hazards, one method of abatement would be to follow the safety practices and procedures, equipment use, personal protective equipment, job planning and other precautions outlined in American National Standards Institute (ANSI) Z-133.1 and ensure employees understand the hazards involved in tree-trimming work.
