Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On or about February 21, 2007, at a worksite located at or near 3514 NW 95th Street, Kansas City, Missouri, employees were exposed to possible fall and/or amputation hazards from "riding the bucket" of a New Holland backhoe to get into and out of trenches. The fall hazards included falling over 10 feet to the bottom of a trench and the amputation hazards were posed by the scissoring actions from the backhoe's articulated arm and bucket attachment. An acceptable means of abatement would be to positively require employees to maintain a safe distance from the backhoe or any of its moving parts anytime the device is in operation, and to provide ladders, ramps or stairways so that employees have a safe means for getting into and out of trenches. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
