T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that the employer had not developed and/or implemented safe work practices and/or procedures, including safe rigging procedures, capacities of equipment and components, adequate elevator car suspension, and proper procedures for removal of jack head/plunger, to protect employees required to work under a suspended elevator car. Failure to implement safe work procedures resulted in the overloading and failure of rigging components while performing maintenance on a hydraulic elevator, resulting in an employee being struck by a falling elevator car. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to develop, implement, and monitor the use of job specific safe work procedures.
