Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and caught between hazards during drilling operations, and during erecting and dismantling of the drilling rigs. Specifically: On or about June 30, 2006, and times prior thereto, the employer failed to ensure that the derrick and its auxiliary parts were maintained in a safe condition by ensuring that all parts were visually inspected to detect any defects that did not conform to good engineering practice. A piece of angle iron (step) and the welds connecting it to the A-Frame leg had rusted throughout the connection causing it to fail during the rigging down process, exposing employees to struck by and caught between hazards. This was most recently observed at the Briggs #1 well located on the Long Davis Trust Lease located off of FM 1794 near Carthage, TX. Among other methods, one feasible means of abatement includes, but is not limited to complying with Section 9.2.1 of the American Petroleum Institute RP 54, Third Edition, August 1999.
